No further stay on visitor visas is not the student story. The student door closed in 2024.

Visitor visa holders have been unable to apply for a student visa onshore since 1 July 2024, so the Minister’s new “no further stay” measure is not the student story. For RTOs, the immediate risk is marketing or agent scripts that still imply visitors can switch to study.
Since 17 September, some prospective students and agents have been asking whether the Minister's new "no further stay" measure for visitor visas shuts off a student pathway. It does not, because that pathway is already shut. Visitor visa holders have been unable to apply for a student visa in Australia since 1 July 2024. The real risk for RTOs is not the new rule. It is anyone still selling the old idea.
What the Minister actually said
At the National Press Club, Home Affairs Minister Tony Burke framed the visitor visa change around family migration: "We'll be attaching to visitor visas a no further stay provision". He said it would not stop protection applications, but would apply "with respect to other applications for people coming on visitor visas", and that "It will have no impact on anybody who is already here because this is about the issuing of future visas and the rules for future visas" (Minister for Home Affairs, National Press Club speech). No commencement date was given.
His examples were partners who come as visitors and apply onshore, and families visiting for milestones or ageing relatives. Students were not the target of that part of the speech.
The contrarian point: the student door closed two years ago
Home Affairs announced that "From 1 July 2024, Temporary Graduate, Visitor and Maritime Crew visa holders will be unable to apply for a Student visa while in Australia", and that "Visitor visa applicants who intend to study will be required to apply for their Student visa from offshore" (Department of Home Affairs). Study Australia still states that holders of certain visas, including Visitor, Temporary Graduate and Maritime Crew visas, cannot apply for student visas while in Australia (Study Australia).
| Visa held in Australia | Can apply for a student visa onshore? |
|---|---|
| Visitor (subclass 600) | No, since 1 July 2024 |
| Electronic Travel Authority (601) and eVisitor (651) | No |
| Temporary Graduate (485) | No, since 1 July 2024 |
| Medical Treatment (602), Transit (771), Maritime Crew (988) | No |

Some visitor visas already carry condition 8503 "No Further Stay". The Sponsored Family stream page, for example, says holders cannot apply for a new visa in Australia because of it, although it can be waived in limited circumstances, and that visitors can study or train for up to 3 months (Department of Home Affairs, Visitor visa Sponsored Family stream). The proposal extends that kind of condition to future visitor visas more broadly.
Why this matters for RTO recruitment
The Minister's broader theme was ending visa hopping, which he described as people who "jump from visa to visa" to stay as long as possible (Minister for Home Affairs). A recruitment conversation that begins "come over on a tourist visa and we'll sort out study later" is now doubly out of step. It cannot work under the 2024 rules, and it is the behaviour the government is openly targeting.
There is also an upside. Students who apply offshore, with a clear course plan and a well-prepared Genuine Student case, are exactly the students this system is designed to welcome. The 2027 planning level announcement says "any genuine student who meets the Student visa requirements can still apply and be granted a visa" (Study Australia).
What RTOs should do now
1. Audit your marketing and agent scripts
Remove anything that suggests a student can enter as a visitor and switch to study. Check social media posts, landing pages and agent materials.
2. Answer the question directly at enquiry stage
Many enquiries come from people already in Australia on visitor visas. Tell them plainly that a student visa must be lodged from outside Australia, and refer them for advice.
3. Separate short courses from student visa courses
If you enrol visitors in short courses, make sure the course fits the study allowed on their visa and is not presented as a stepping stone to a student visa onshore.
4. Build a clean offshore pipeline
Invest in Genuine Student preparation, document checklists and realistic intake dates, so offshore applicants arrive ready.
5. Keep students on track once here
Once a student is onshore on a student visa, attendance, progress and upward course planning under condition 8202 are what protect their future options.
What it means for students onshore and offshore
Offshore, if you want to study in Australia, apply for the student visa before you travel. A Brazilian student in their twenties, a young Filipino student or a mature-age Pacific student all follow the same rule. Visiting first to "look around" is fine as a holiday, but it will not let you switch to a student visa here.
Onshore on a visitor visa now? The Minister said the new measure will not affect people already here. But the 2024 rule already stops you applying for a student visa in Australia. Get advice before you enrol or pay fees.
